Terms of Service — Zoestra Studio

1 Acceptance of Terms

By accessing or registering with Zoestra Studio ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not register for or use the Platform. These terms apply to all users, including learners, parents, guardians, teachers, administrators, and visitors.

2 Registration and Accounts

When you register an account on Zoestra Studio, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Zoestra Studio reserves the right to suspend or terminate accounts that violate these terms or provide false information.

3 Media and Image Consent

By registering for Zoestra Studio programs and activities, you grant Zoestra Studio the right to capture, use, and publish photographs, videos, audio recordings, and other media (collectively "Media") of registered participants during studio activities, events, showcases, workshops, and related functions. This includes, but is not limited to:

Use of Media on the Zoestra Studio website, social media platforms, and promotional materials.
Use of Media in newsletters, brochures, advertisements, and press releases.
Use of Media for archival, educational, and internal training purposes.
Display of Media during the Talent Showcase and other public events.

Media will be used solely for purposes related to Zoestra Studio's mission, programs, and community engagement. We do not sell or license Media to third parties for unrelated commercial purposes. If you wish to withdraw consent for future use of Media, you must submit a written request to Zoestra Studio. Previously published or distributed Media may not be retracted.

4 Code of Conduct

All participants, including learners, staff, parents, and visitors, are expected to treat one another with respect, kindness, and professionalism. Harassment, bullying, discrimination, or any form of disruptive or harmful behavior will not be tolerated and may result in immediate removal from the Platform and its programs without refund. Participants must follow all safety guidelines and instructions provided by Zoestra Studio staff during activities.

5 Intellectual Property

All content, materials, logos, designs, course materials, and software on the Zoestra Studio Platform are the exclusive property of Zoestra Studio or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written consent. Learners retain ownership of their own creative works produced during programs, but grant Zoestra Studio a non-exclusive, royalty-free license to display and promote such works in connection with the Platform.

6 Privacy and Data Protection

We collect and process personal information in accordance with applicable data protection laws. The personal data we collect during registration (including names, contact information, age, and program preferences) is used solely to administer our programs, communicate with participants, and improve our services. By registering, you agree to receive marketing emails and event notifications from Zoestra Studio. You may opt out of marketing communications at any time by following the unsubscribe link in any email or by contacting us. We implement reasonable technical and organizational measures to protect your data against unauthorized access, disclosure, or loss. We do not sell personal data to third parties.

7 Health and Safety

Parents and guardians are responsible for informing Zoestra Studio of any medical conditions, allergies, or special needs that may affect a learner's participation in programs. Zoestra Studio takes reasonable precautions to ensure the safety of all participants, but cannot be held liable for injuries, accidents, or health incidents that occur during program activities, except where such liability is mandated by law. Participants engage in all physical activities, including sports, dance, and games, at their own risk.

8 Program Fees and Refunds

Program fees are due as specified during the registration process. Zoestra Studio reserves the right to modify program pricing at any time, though confirmed registrations will be honored at the rate in effect at the time of registration. All payments are final and non-refundable. By completing your registration and submitting payment, you acknowledge and agree that no refunds will be issued for any reason, including but not limited to cancellation, withdrawal, non-attendance, or early departure from any program.

9 Limitation of Liability

To the fullest extent permitted by applicable law, Zoestra Studio and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or participation in our programs. Our total liability for any claim arising under these terms shall not exceed the amount paid by you for the specific program giving rise to the claim.

10 Prohibited Activities

You agree not to engage in any of the following prohibited activities on or in connection with the Platform:

Scraping, crawling, or using any automated means to extract data, content, or information from the Platform without our express written permission.
Attempting to probe, scan, or test the vulnerability of any system or network connected to the Platform.
Introducing viruses, trojans, worms, logic bombs, or any other malicious or technologically harmful material.
Attempting to gain unauthorized access to, interfere with, damage, or disrupt any part of the Platform, the server on which it is stored, or any server, computer, or database connected to the Platform.
Using the Platform to send unsolicited communications, spam, or phishing attempts.
Impersonating Zoestra Studio staff, other users, or any other person or entity.

Any violation of this section will result in immediate termination of your access to the Platform, and we reserve the right to pursue all available legal remedies, including reporting such activities to relevant law enforcement authorities and seeking civil and criminal penalties to the fullest extent permitted under Kenyan law. We actively monitor for scraping and malicious activity and will take swift action against offenders.

11 Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without notice, for any conduct that we believe violates these Terms of Service or is otherwise harmful to Zoestra Studio, its participants, or any third party. Upon termination, your right to use the Platform ceases immediately.

12 Changes to Terms

Zoestra Studio reserves the right to update or modify these Terms of Service at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

13 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes, claims, or legal proceedings arising out of or in connection with these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya. By using this Platform, you irrevocably submit to the jurisdiction of the Kenyan courts.
